Man linked to stealing, defiling 15-year-old girl detained pending bond ruling

A Somali man accused of stealing a 15-year-old girl, before allegedly defiling her, appeared at Makadara law courts on Wednesday, November 26.
He denied the charges against him.
The accused, Musaab Hasan Jimale, according to court papers, stole and harboured A.M.S., by enticing her to follow him with intent to deprive her Mother, F.M. the lawful custody and care, on November, within her home in Eastleigh.
Consequently, Jimale, who will remain in custody pending ruling on his release terms, was also charged with defiling the said girl on the same day and committing indecent act.
Reportedly, the victim, who lives with her mother in Eastleigh, met with the accused person two days before the incident, and he allegedly gave her his number.
They then met on the fateful day at a warehouse where he worked as a shopkeeper.
He told the minor that there was something he wanted to tell her at his house. They proceeded to an apartment where he gave her a pill to swallow, which made her unconscious for two and a half hours.
Much later, he moved her to a different house where he undressed while forcing his way with her.
In an attempt to raise an alarm due to the discomfort, the accused allegedly stuffed the minor's mouth.
Reportedly, she passed out due to the extreme pain she endured during the heinous act. Ten hours later, she regained consciousness the following morning at around 8 pm.
The accused is said to have forced the minor to take a shower and not to leave the premises without his consent.
Her mother, who was worried about her disappearance, reported the matter to police officers at Eastleigh North, hence sparking her search.
It took the intervention of the caretaker to assist police with the number which the girl had dialled through his mobile phone belonging to the accused person.
The accused was traced and arrested at a shop. He led the police officers to his rented house, where the minor was found in a bad state. The matter was booked at the police station pending questioning and medical examinations.
Jimale denied claims before Chief Magistrate Beatrice Kimemia, with the defense counsel Pamela Illuvya arguing that the accused person was a minor and a student in Eastleigh, thus seeking guidance.
She urged the court to be supplied with the affidavit filed to oppose the bond.
The state counsel, Susan Kibung, challenges the defence application, noting that no documentation had been tendered in court showing that he was a minor or a student.
Further in her application, Kibungi informed the court that, " the nature of the offence is serious." She said while quoting Article 48, which grants the arrested person the right to bond or bail.
"However, the same is not absolute but a matter of the court’s discretion since rights to bond and bail can be waived when compelling reasons are tabled.
Before court is an affidavit sworn on November 26, objecting his release on bond since he is a flight risk, his permanent residency is unknown and he is likely to abscond court if release since the crime committed attract heavy penalty." Kibungi said.
In addition, she stated that the accused person was unlawfully present in Kenya as per the charge sheet, and as such, it buttresses the provisions that he is likely to abscond from court.
"He is likely to interfere with the witnesses closer to him, and the victim needs to be protected since they reside in the same area"
The defence counsel, Professor Hassan Anandwa, argued that the affidavit tendered before the court clearly indicated that the accused person is at flight risk, being a foreigner, illegally present in Kenya. Given the volatile nature of - Kenya-Somalia border.
We pray to the court to dismiss the defence claims of the accused being a student and a minor, and deny him bond and bail until the case is heard and determined.
"Having considered the applications and submissions from the parties, I hereby direct the accused person to be taken for age assessment pending further determination. The matter will be mentioned on Friday, November 28." Kimemia directed.
