Sh100 million kick: Rider sues governor Otuoma over alleged hit on groin

An alleged Busia Governor Paul Otuoma’s kick could be the most expensive run-in in the country if a case filed by the alleged victim, a boda boda rider, is allowed by the High Court.
Yusuf Suleiman Hamisi, 31, is seeking Sh100 million as compensation for allegedly being hit by the governor on his groin during a maize donation exercise on March 6, 2026.
In his case, filed before Justice Bahati Mwamuye, Suleiman, narrated that on the fateful day, he, alongside other constituents, went to receive certified maize which was being distributed to farmers by the governor at Bukri market.
He further stated that he patiently waited in the queue until his turn to receive the same came, but there was an elderly person before him.
Suleiman said that he decided to hand the maize held by the governor, but he instead got a kick and a scold from the county chief. This kick, he claimed, landed on his private part.
“He was simply attempting to hand over a seedling to a woman standing next to him — a legitimate and innocuous act clearly visible on video footage. Without any justifiable provocation, the 1st Respondent verbally confronted him in Swahili with the words “Wewe toka hapo” (“You, get out of there”), then delivered a deliberate and forceful flying kick directly to the victim’s groin area. The kick caused the victim to stumble backwards in excruciating pain,” his lawyer Shadrack Wambui told the court.
To add salt to injury, the court heard that the governor’s handlers allegedly chased him out of the venue.
His other lawyer, Dunstan Omari, said that he allegedly sought medical help from Sioport Sub-County Hospital in Busia County but was turned away.
According to Omari, his client was refused treatment and a P3 form owing to an alleged influence by the governor.
He alleged that there were subsequent attempts to allegedly threaten Suleiman, adding that it is a plot to allegedly silence him.
“The victim had reported the matter at Sioport Police Station on Tuesday at 0900 hours under OB Number 10/10/03/2026. The delay in reporting stemmed directly from the nature of the groin injury, the victim being publicly labelled an “enemy of the Governor,” and his immediate fear for his life. On the same day (11 March 2026), two men visited his residence and demanded that he withdraw the complaint. Furthermore, the victim was abducted but managed to escape. He thereafter contacted a friend who assisted him in going into hiding, where he remains to this day,” claimed Omari.
Sulieman sued Otuoma, the office of the Governor Busia, and the Speaker of Busia County. He also roped in the Ethics and Anti-Corruption Commission (EACC), the Director of Public Prosecution (DPP) and the Inspector General of Police as interested parties.
He wants the court to find that Otuoma had violated the law and his rights by kicking him, and alleged attempted threats.
At the same time, he is seeking an order that the governor’s conduct was unacceptable and a violation of the leadership and integrity principles.
He is also seeking an order to compel the DPP to order a probe and to charge the governor.
Suleiman is also seeking Sh100 million as compensation for alleged psychological trauma, loss of dignity, cultural affront to his manhood, public humiliation, ridicule and embarrassment in his marriage and community.
