Man slapped with 20 years imprisonment for defiling and impregnating daughter aged 12

A man has been jailed for 20 years after he was found guilty of defiling and impregnating his 12-year-old daughter.

Principal Magistrate Christine Oruo at Rongo Court said that the prosecution proved its case against Joram Thomas to warrant a conviction.

“The accused’s defense was mere denial, full of half-truths, and was not convincing to the court,” Mr. Oruo said.

He was found to have defiled the minor on diverse dates between July 2023 and 2023 at Mateta area, Awendo Sub-County in Migori County.

According to the judgment, the complainant indicated that the accused person was known to her and that from the month of July to December 2023, the accused defiled her on several occasions.

The court found that the accused would defile the minor when her mother had gone to work or church.

“He would order her to remove her clothes and would defile her,” Oruo said in his judgment.

It was on December 22, 2023, that the minor realized she was expectant when she had been taken to Awendo Sub-County Hospital for examination.

The medical evidence by the clinical officer indicated that the minor was examined and was found to be expectant.

A DNA analysis was also carried out by government chemists to ascertain the paternity of the unborn child.

Samples of the accused person and the minor were taken and the analysis outcome confirmed 99.9 percent chances that the accused person was the biological father of the unborn child.

The DNA report together with the exhibit memo were produced as exhibits by the government analysts while the P3 form, PRC form, filter and lab request forms of the minor were produced by the clinical officer.

According to Oruo, the minor positively identified the accused person as the perpetrator.

“They have been living with him together with her mother. She positively identified the accused as the perpetrator,” the judgment read.

The accused had denied the charges but in his plea to the court before conviction, he blamed the influence of alcohol for his acts.

He told the court minutes before conviction that he was under the influence of alcohol and did not know what he was doing.
