Security guard convicted for killing a man over a lover's affair

A security guard who stabbed a man 30 times two years ago after he allegedly found him with his wife at their matrimonial home has been found guilty of murder.
Justice Samwel Mohochi convicted Cyrus Rono for killing Moody Mukutsa on August 29, 2023, at Lanet, in Nakuru County.
The court convicted Rono, pointing out the seriousness of the injuries that led to the death of Mukutsa.
“The magnitude and seriousness of the injuries inflicted establish the malice aforethought; how the body was found is indicative of the depth of violence he suffered at the hands of the assailants,” Mohochi noted.

Mohochi heard that Mukutsa was having an affair with Rono’s wife in the couple's matrimonial home when the incident occurred.
The court noted that Rono intended to cause death or grievous harm.
The court said provocation and self-defence invoked are not fortified, and that the same are inconsistent with the principle of reasonable response following provocation, if any.
“In totality, having considered the evidence adduced in this case, it is my finding that the prosecution has proved its case against the accused beyond a reasonable doubt. I find Rono guilty of the offence of murder contrary to Section 203 as read with Section 204 of the Penal Code and is hereby convicted accordingly,” Mohochi ruled.
Mukutsa’s brother, Miyao Nelson, said he knew Rono, and they never had bad blood, as they were childhood neighbours.
The pathologist, Dr Titus Ngulungu, revealed that Mukutsa's body had slash and stab wounds.
Ngulungu said the stab wounds were distributed across the body, claiming they might have been caused by fury.
He opined that Mukutsa died as a result of a head injury due to a blunt object and sharp trauma.
Corporal Julius Rop testified that while on duty, at around 11:45 pm, Rono confessed to killing a man in his house.
In the company of other officers, Rop went to Rono’s house, where he opened the padlock to his three-roomed house and ushered them into where Mukutsa's body was.
He arrested Rono, secured the scene, and reported to his superiors.
The investigating officer, Joseph Ngure, testified that at the scene, Mukutsa's body had injuries all over the body, hands, head, and other parts.
He is said to have recovered the murder weapon, a slasher, from Rono’s friend, called Chege.
Rono's wife wasn’t around at the time they went to the couple's house, and after, she refused to testify against her husband.
Rono, in his defence, said that he left his house at around 6 pm for the night guard.
He made several telephone calls that night to his wife, which went unanswered.
He claimed that he wanted some money he had forgotten in his trousers at the house.
He became suspicious, prompting him to go home, only to meet with a shocking revelation.
He claimed to have knocked on the door, and his wife responded. He discovered a man’s shoes on the floor, which weren’t his.
Rono allegedly enquired about the shoes, but the wife remained mum. Shortly, the man emerged from under the bed, took a knife, and pushed him.
Out of anger, he said he attacked Mukutsa.
He then locked his house and left in the company of his wife for Chege’s place, leaving the lasher with Chege to guard Mukutsa against escape while he went to report.
