Why lawyer Angela Mulwa has been re-arrested

City lawyer Angela Mulwa has this afternoon been re-arrested outside the Milimani Law Court in connection with the murder of her stepmother, Dr Victoria Mutiso.

The arrest came shortly after the Director of Public Prosecutions Renson Ingonga recommended that the law be charged with the murder of the deceased.

Fresh details emerged on Monday after the prosecution confirmed before Milimani Magistrate Joan Mati that a murder charge against Mulwa had been filed at the High Court earlier in the morning under case E004 of 2026.

State prosecutor Jalson Makori informed Magistrate Mati that the filing of the substantive murder charge had prompted the prosecution to withdraw a fresh application by the Directorate of Criminal Investigations seeking to detain Mulwa for 14 days to enable completion of investigations

Makori told the court that the State had now formally moved to charge Mulwa with murder.

“We have demonstrated to court that now we are formally charging the respondent for an offence of murder,” the prosecution told the court.

The State further argued that the Sh1 million bond terms Mulwa was enjoying were related to a separate matter pending before Mavoko and different offences of forging a title Deed, malicious damage to property and theft of Motor vehicles.

With the murder charge filed before the High Court, the prosecution asked Mati to withdraw the DCI miscellaneous application which had sought to have Mulwa detained as detectives completed investigations.

Magistrate Mati allowed the withdrawal and closed the file.

The magistrate noted that a charge had been filed at the High Court under E004 of 2026, which was registered that morning.

“Based on the above, the application to withdraw the application is hereby allowed. This file is closed,” Mati ruled.

The DPP's decision follows allegations contained in the DCI's investigation papers placing Mulwa at the centre of events surrounding Dr Mutiso's killing.

Detectives allege that Mulwa played a vital role as she was present on April 24, 2026, when Sh300,000 was allegedly paid as a down payment for an earlier attempt to have Dr Mutiso killed.

The DCI says that attempt failed to materialise but forms part of the evidence linking Mulwa to the alleged murder plot.

“She was present on April 24, 2026, during the payment of the Ksh300,000 down payment for the deceased to be murdered, which failed to materialise,” the DCI investigator Corporal Romana Oduor said in an application. 

Investigators further allege that Mulwa maintained constant communication with Inspector Kenneth Kipkemboi Sang, a senior police officer whom the DCI has identified as a key suspect in the wider murder conspiracy as still at large.

According to the investigators, Sang's firearm was allegedly used in the killing.

The DCI says ballistic examination linked a Mini Jericho pistol, serial number 47302127, to cartridges and a bullet fragment recovered from the murder scene.

The DCI has also alleged that Mulwa played a role in events surrounding the eviction and demolition of multi-billion-shilling property linked to Dr Mutiso, saying her presence during the operation.

Dr Mutiso was shot dead on July 29, 2026, while travelling in Nairobi's Upper Hill area.

The DCI had previously said the murder involved police officers, with Inspector Sang identified as an alleged link between the financiers and operational team, while Police Constable Elijah Kibelion Kimoi was identified as the alleged gunman.

Mulwa is expected to face the murder charge before the High Court tomorrow alongside her mother, Rose Mbithe Mulwa, and brother Chris Mulwa, as well as Police Constable Kibelion, businessman Daniel Mwangi Njoroge (driver of the Land Cruiser Prado allegedly used in the operation) and boda boda rider Kevin Ngugi Kinuthia, as the State escalates prosecution over the killing of Dr Victoria Mutiso.
