Universities, unions clash over human resource policies

Kenya Universities Staff Union (Kusu) has opposed attempts by Vice Chancellors (VCs) of public universities to alter human resource policies and procedures, arguing that such mandates lie solely with university councils.

Kusu Secretary General Charles Mukhwaya emphasized that VCs and principals of constituent colleges lack the legal authority to develop human resource instruments without council approval.

“Vice chancellors of public universities and principals of Constituent Colleges have no legal mandate to develop HR Instruments, as this mandate falls under the purview of University Councils, and is a negotiable item with unions,” said Dr Mukhwaya.

The standoff opens the lid on the growing tension between university administrations and staff unions, as both sides push for control of HR policies governing employment terms and conditions.

Dr Mukhwaya on Wednesday warned that any attempt by VCs and principals to unilaterally develop such policies amounts to “usurping the role of university councils, abuse of office, and blatant violation of the law.”

Kusu raised concerns over administrators who have expended public resources on drafting HR instruments without adhering to the provisions of the Universities Act 2012.

“The said administrators have expended public resources purporting to draft HR instruments contrary to the provision of the Universities Act 2012 and other enabling legislations; while at the same time permanently bothering government with incessant claims that public universities do not have resources. They must be surcharged and held accountable for any misuse of public funds,” he stated.
