Gachagua threatens suit in Sh25m apartment row

Former Deputy President Rigathi Gachagua has threatened legal action against a property firm over allegations linking him to an unpaid Sh25 million for an apartment.

Through his lawyer, Moses Mabeya, Gachagua dismissed the claims as defamatory, insisting he was a stranger to any arrangements between Julia Muthoni Mwangi and Royal Importers and Exporters Limited. He demanded an apology within 24 hours or face a defamation suit.

“Unless we receive your evidence of compliance with the above demands, within twenty-four (24) hours, you will leave us with no alternative but to file a lawsuit against you for defamation at your peril and other incidental costs. We have strict and peremptory instruction to seek general, aggravated and exemplary damages, along with the cost of the suit without further reference to you,” demanded Mabeya.

The row began on September 30, when Royal Importers’ lawyer, Dr Adrian Kamotho, issued a joint letter to Gachagua and Muthoni demanding that they admit liability and pay the outstanding sum.

Kamotho accused Muthoni of illegally occupying Skyrock Apartment Unit 2 without settling the agreed price.

“Despite your failure to settle the price, you have in utter impunity remained in unlawful occupation of our client’s premises. Our client has been magnanimous, anticipating that you would honour your obligations. Instead, you have chosen to take our client for a ride,” he wrote.

The lawyer warned that unless Muthoni and the Democracy for Citizens Party (DCP) leader complied, Royal Importers would pursue all legal measures available.

Muthoni, however, disputes the claim. Through her lawyer, Obano Ondigi, she described the demands as baseless and insisted that she had already paid the full amount. He added that Royal Importers had acknowledged receipt of payment but had failed to provide the necessary completion documents.

“Accordingly, there is no outstanding sum due from our client, a fact acknowledged by your client under their own hand. Your demand of any monies owed is therefore denied in total,” said Mr Ondigi.

He further accused Royal Importers of breaching its obligations by refusing to issue Ms Muthoni with the documents, demanded that the company should retract the demand and proposed arbitration to resolve the matter.

“Any threats of interference or eviction will be met with strong opposition and the full force of the law, as they amount to infringement of her rights,” Mr Ondigi added.
