EACC reveals it's probing counties for corruption cases worth billions

The Ethics and Anti-Corruption Commission (EACC) is investigating several corruption cases in counties in which billions of shillings may have been misappropriated.

EACC Chief Executive Abdi Mohamud said they have received 288 reports from the Senate County Public Accounts Committee from 2022 with six of them having been concluded in court, seven of them pending in court while 74 of the matters have been referred to other agencies for action.

Mohamud told the Senate Justice and Legal Affairs and Human Rights Committee that 125 matters are pending under investigation, 69 matters have been prioritised for investigation in phase two while seven files have been forwarded to the Director of Public Prosecutions (DPP).

The CEO told the committee chaired by Bomet Senator Hillary Sigei that the commission issued an advisory on rampant falsification and forgery of academic certificates and issued an advisory on the management of existing staff, new recruitment and pending bills in the county governments.

Mohamud said they issued an advisory on the declaration against irregular procurement and misuse of public resources in mitigation measures for the El Nino rains, on rampant misapplication of imprests by public officers and on integrity during vetting of persons nominated for appointment as County Executive Committee members.

Mohamud told the Senate that an inquiry into allegations that in the financial year 2019/2020 the Kitui County Executive could not account for expenditure amounting to Sh10.4 billion due to a fire that destroyed documents was referred to the Directorate of Criminal Investigations.

He said they had recommended a special audit by the Office Auditor General an inquiry into allegations that Turkana County Government had accumulated pending bills amounting to Sh493 million in the financial year 2017/2018.

“We are currently investigating allegations into payment of Sh541 million by Narok County Government to Lalji Meghji Patel & Company for the construction of Narok County Hospital with allegations that despite payment done, the works are not complete and the contract period has lapsed,” said Mohamud.

The CEO said they are carrying out an inquiry into unaccounted for expenditure for the Isiolo County Government amounting to Sh455 million which includes grants and payment at Sh274 million, expenditure of goods and services at Sh47 million and acquisition of assets at Sh64.7 million.

Irregular expenditure

Mohamud said that they are also carrying out an inquiry into the allegations that the County Government of Kisumu made an ineligible payment of legal fees of Sh137.6 million to Ken Pundo and Company Advocates in respect to a case in the High Court concerning the Municipal Council of Kisumu.

The EACC boss said they are also carrying out an investigation into payments totalling Sh121 million to various suppliers made without any supporting documentation and delivery of goods notes by the Kisumu County Government.

“We are also carrying out an inquiry into allegations of irregular expenditure of Sh187 million by the Nakuru County Government in the purchase of business items which includes tents, chairs, umbrellas, motorbikes, shaving machines and water tanks that were donated to the public,” said Mohamud.

EACC is also carrying an inquiry into an allegation that Sh405 million was irregularly paid to a contractor in respect of the proposed upgrading of Eldoret’s 64 Stadium in the financial years 2020/2023 whereas there is no contractor on site and the work is not completed.

Mohamud told the Senate that EACC is investigating allegations of unremitted liquor fess to the Liquor Licensing Fund Bank Account amounting to Sh110 million in Homa Bay County for the period 2015/2016 to 2021/2022.
