KDF impersonator charged with obtaining Sh1.2m in fake military recruitment

Joshua Mutui Muimi, who is accused of impersonating a Kenya Defence Forces (KDF) Brigadier, has been charged with obtaining over Sh1.2 million from two men after allegedly promising to help their children secure admission to the military Recruit Training School (RTS) at Moi Barracks in Eldoret.

Mutui appeared before Milimani Senior Principal Magistrate Dolphina Alego on Monday, where he denied four counts, including personation, obtaining money by false pretences, and being in possession of public stores.

He was charged that on November 17, 2025, at Cherrywood Apartments within Kilimani Sub-county in Nairobi, with intent to defraud, he falsely represented himself as a Kenya Defence Forces military officer in the rank of Brigadier, contrary to Section 382 of the Penal Code.

In the first count on possession of public stores, the court heard that on the same date and at the same place, Mutui had in his possession public stores, namely one pair of Kenya Air Force combat dress, two slip-ons of rank Brigadier, two gorget patches of ranking officer Brigadier, and one Kenya Air Force badge of rank Brigadier of the Kenya Defence Forces, such property being reasonably suspected of having been stolen or unlawfully obtained, contrary to Section 324(2) as read with Section 36 of the Penal Code.

In the third count of obtaining by false pretences, the charge sheet states that on October 7, 2025, at Cherrywood Apartments within Kilimani Sub-county, jointly with others not before court, with intent to defraud, he obtained from Kenneth Lomerical Kimaiwa the sum of Sh700,000 by falsely pretending he was in a position to give a Kenya Defence Forces admission letter to his son, Kelvin Chilimo Kimaiwa, to join Recruit Training School (RTS) at Moi Barracks in Eldoret, a fact the prosecution says was false.

In the fourth count, Mutui is accused that on November 10, 2025, at the same apartments, jointly with others not before court, with intent to defraud, he obtained from Robert Kipkurui Ng’etich the sum of Sh510,000 by falsely pretending he was in a position to give a Kenya Defence Forces admission letter to his daughter, Brenda Chepkorir, to join Recruit Training School (RTS) at Moi Barracks in Eldoret, contrary to Section 313 of the Penal Code.

According to an affidavit sworn by the investigating officer, Police Constable Wilson Kamundi of DCI Parklands, Mutui is alleged to have been issuing fake Ministry of Defence calling letters to unsuspecting Kenyans, instructing them to report to RTS in Eldoret.

“During a search conducted at Cherrywood Apartments, we recovered six admission letters, seven calling letters with identical serial numbers, seven fingerprint forms, a Yilmaz Defence manufacturing solutions manual, the suspect’s national identity card, a KCSE certificate suspected to belong to one of the victims, and a Toyota Axio motor vehicle registration number KDJ 473A bearing a Kenya Defence Forces sticker,” PC Kamundi states in the affidavit.

The court was informed that the complainants had been introduced to Mutui as a senior KDF officer who could facilitate their children’s recruitment into the military.

Mutui, however, pleaded not guilty to all the charges.

“I deny all the charges,” he told the court.

Magistrate Alego ordered that he be released on a bond of Sh1 million, with an alternative cash bail of Sh500,000.

“You shall be released on a bond of Sh1 million or alternatively a cash bail of Sh500,000,” ruled Magistrate Alego.

The case will be mentioned after 14 days for pre-trial.
