Nairobi. City Hall put on the spotlight in dispute over septic tank in Pangani

City Hall’s urban planning has been put on the spotlight for approving construction of a septic tank between two apartments in Pangani Nairobi.

And now Hanif Construction Company Limited launched a complaint against the developer, Osman Ali Abdi, through a chain of letters to Governor Johnson Sakaja.

The case has also been filed at the Environment and Lands court.

In a letter dated July 6, 2026, the complainant wrote to the governor through Mengich and Company advocates asking for attention over the matter.

“’Despite several requests to cease operations, the developer persists in these unlawful acts and omissions, thereby interfering with our client's use of, occupation and access to their private property,” the letter reads in part

Adding, “In view of these findings, it is evident that the developer will continue unabated, with impunity and in complete disregard of by-laws and building code unless you intervene and investigate these illegal activities with immediate effect,”

It stated also that the construction of a water tank between the property and the adjacent plot raises significant concerns regarding safety, drainage, sanitation, hygiene, and potential structural damage.

“The ongoing construction poses a threat to the walls of both buildings, as the water tank may obstruct access and create health risks for residents and the surrounding neighborhood,"

The letter also stated that if the construction works are not halted with immediate effect and a thorough investigation undertaken to establish whether approvals were obtained and due process followed, the governor would be held liable for any resulting risk, loss and liability.

“We hereby give you notice of indemnification and liability for any losses and damages arising from these unlawful and illegal developments. Kindly but urgently take the necessary steps to avert imminent loss or damage to our client's property,”
